2. Processing Takedown Notices

Upon receiving a valid DMCA takedown notice, Hypnotube will take the following actions:

  • Prompt Removal: We will promptly remove or disable access to the allegedly infringing material.

  • Notification: We will notify the user who posted the content (if identifiable) that the material has been removed or disabled due to a copyright infringement claim.

  • Record Keeping: We will maintain records of the takedown notice for compliance and legal purposes.

3. Counter-Notification Process

If you believe your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to restore the content. Your counter-notification must include:

  • Identification of the Removed Material: A description of the material that was removed or disabled and the location (e.g., URL) where it appeared before removal.

  • Statement of Consent: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.

  • Your Contact Information: Your full name, mailing address, telephone number, and email address.

  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the U.S. District Court for the District of Delaware) and that you will accept service of process from the person who submitted the original DMCA notice or their agent.

  • Your Signature: A physical or electronic signature.

Upon receiving a valid counter-notification, Hypnotube will:

  • Provide a copy of the counter-notification to the original complainant.

  • Inform the complainant that the removed material may be restored in 10 business days unless the complainant notifies us of a court action seeking to restrain the alleged infringement.

  • Restore the material within 10-14 business days, unless we receive notice of a legal action to restrain the content.

4. Repeat Infringer Policy

Hypnotube maintains a policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A “repeat infringer” is a user who has been notified of infringing activity more than twice or has had content removed for infringement more than twice, as determined by Hypnotube in its sole discretion.

5. Misrepresentation

Submitting a false DMCA takedown notice or counter-notification may have legal consequences. Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material is infringing or was removed by mistake may be liable for damages, including costs and attorney’s fees incurred by the affected parties.

6. Modifications to this Policy

Hypnotube reserves the right to modify this DMCA Policy at any time. Any changes will be posted on this page with an updated effective date. Your continued use of the platform after changes are posted constitutes your acceptance of the revised policy.
